These Terms of Service ("Terms") are an agreement between you and Spoons LLC ("Spoons," "we," "us," or "our"). They govern your use of the Spoons mobile application (the "App") and getspoons.app (the "Website"), together called the "Service." By selecting Agree, confirming a purchase or trial through Apple App Store or Google Play, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Read This First — Plain-Language Overview
This overview is for convenience. The numbered sections below control.
- Spoons is an energy-tracking and reflection tool. It is not medical care, a medical device, an AI coach, or an emergency service.
- Core use does not require a Spoons account. Energy logs and reflection calculations stay on your device and are not automatically sent to Spoons.
- Spoons offers a 90-day full-access trial. The trial format may differ by platform. A trial that begins through Apple or Google may automatically become a paid, renewing subscription only after you explicitly confirm those terms in the store.
- The United States base price is $2.99 per month or $29.99 per year. Spoons will not raise the Spoons-set base price. A compressed five-tier regional schedule gives lower-income territories lower prices; Appendix A lists the current territory assignments and local base prices.
- Your existing history and export access are not intentionally held behind a subscription paywall, even after a trial or paid subscription ends.
- Spoons makes binding commitments concerning privacy, non-manipulative design, the Diagnosis Fund, diagnosis access, data portability, accessibility, and business continuity.

1. Eligibility
You must be at least 13 years old to use Spoons. If you are not old enough to enter a binding agreement where you live, a parent or legal guardian must review and agree to these Terms for you. You may not use the Service where doing so would violate applicable law.
Spoons is designed primarily for autistic adults, but eligible teenagers may also use it.
2. What Spoons Is — and Is Not
Spoons lets you record energy levels, review locally stored history, and receive reflections based on patterns in the information stored on your device. Features may develop over time, but the binding core-design commitments in Section 3 remain applicable.
Spoons provides general self-reflection information only. It does not provide medical, psychological, legal, employment, disability, accommodation, diagnostic, or treatment advice. It is not a medical device and is not a substitute for a qualified professional.
Spoons does not promise to prevent, predict, diagnose, or reduce burnout, shutdowns, meltdowns, health problems, workplace problems, disability-related problems, or crises. Energy averages, visualizations, reflection cards, and pattern descriptions may be incomplete, inaccurate, delayed, or unsuitable for a particular decision. Decisions you make using Spoons remain your responsibility.
Spoons is not an emergency or crisis service. In an emergency, contact the emergency services available where you live.
3. Core Design Commitments
The following commitments define the core Spoons experience and are not merely current feature descriptions:
- Core energy logging will remain low-friction. Recording an energy value will not require a journal entry, explanation, mandatory category, multi-step questionnaire, or Spoons account.
- Spoons will not use streaks, consecutive-day rewards, missed-day guilt messages, competitive rankings, leaderboards, or penalties for not logging.
- Spoons will not use push notifications, artificial urgency, or countdowns to pressure people to engage. Necessary legal, billing, security, or shutdown notices are not engagement pressure.
- Spoons will not become an AI coach or automatically instruct users what medical, employment, accommodation, or personal decisions to make.
- Reflection cards will remain informational, literal, non-diagnostic, and non-prescriptive.
- Core logging, local history, local reflections, import, and export will remain offline-first and will not require a Spoons-operated cloud service.
- New features will not remove the ability to record a basic energy entry without unnecessary friction.
4. Accounts, Local Data, and Privacy Commitments
No Spoons account is required for core use. Spoons will not require your name, email address, password, social login, or a Spoons profile to record energy, view locally stored history, receive local reflections, import data, or export existing logs. Optional future online services may use an account only if those services are clearly optional and declining them does not remove core local functions.
Energy logs and reflection calculations are stored and processed locally on your device. Spoons will not automatically transmit your energy logs to Spoons, create a Spoons-operated cloud database of individual energy histories, access ordinary logs, or build profiles from those logs. You may voluntarily send a screenshot, export, or other information when requesting support.
Your operating system or device backup provider may separately back up App data if you enable that feature. Apple, Google, RevenueCat, and other necessary service providers may process limited purchase, device, security, or technical information under their own terms and privacy policies. Energy logs are not included in Spoons subscription validation.
- Spoons will not display advertising in the App.
- Spoons will not sell or rent personal information.
- Spoons will not sell, license, or monetize energy logs or inferred energy patterns.
- Spoons will not use behavioral advertising, cross-service tracking, or advertising profiles.
- Spoons will not enable optional in-App behavioral analytics for Spoons’ own profiling or engagement optimization.
- The Website will not use advertising or behavioral-tracking cookies. Essential security processing may be used to operate and protect the Website.
Privacy Policy
The Spoons Privacy Policy explains website information, support communications, service providers, retention, deletion, privacy rights, and Diagnosis Fund applicant information. It is part of these Terms and is available at https://getspoons.app/privacy.
5. Trial, Store Confirmation, Subscriptions, Cancellation, and Refunds
Spoons offers a 90-day full-access trial. The way the trial starts may differ by platform, App version, or store configuration. Before a trial begins, the App or the applicable store will identify which format applies.
App-managed trial
An app-managed trial begins without starting an Apple App Store or Google Play subscription. Spoons does not require payment information for this trial. It ends without a charge, and there is nothing to cancel.
Store-based subscription trial
Spoons may use a store-based trial on a platform, including Google Play. To start that trial, you must explicitly confirm an auto-renewing subscription in the applicable store. The store will show the trial length, price, first billing date, billing period, and renewal terms before confirmation.
Unless you cancel before the deadline shown by the store, the store-based trial automatically becomes a paid subscription at the displayed price and continues to renew until canceled. Spoons will not start an auto-renewing subscription without your explicit confirmation in the Apple or Google purchase screen.
A required Google Play purchase screen or hard paywall may be used to begin trial access on Android. This does not remove the rights in these Terms to view existing history and export existing data after trial or paid access ends.
After the trial
When a trial ends, logging new entries may require an active subscription, a valid diagnosis access code, or other valid access. Existing history, import, and export remain available as described in Section 10.
Paid subscriptions
Monthly and annual subscriptions are sold through Apple App Store or Google Play. The store displays the price, billing period, taxes, trial terms, and other purchase information before you confirm.
A paid or store-trial subscription renews automatically until canceled through the store that processed it. Cancellation normally takes effect at the end of the current trial or paid period, subject to the store’s rules. Uninstalling the App does not necessarily cancel a store subscription.
Refunds
Refund eligibility and processing are governed by the applicable store, local law, and the circumstances of the purchase. Submit ordinary refund requests through Apple or Google. Spoons will provide reasonable help understanding the process but cannot promise that a store will approve a refund. Additional shutdown assistance for annual subscribers is described in Section 14.
6. Pricing and the Fair-Price Promise
The United States base price set by Spoons is $2.99 per month or $29.99 per year.
Spoons uses a compressed five-tier regional pricing structure where Apple or Google provides suitable controls. The purpose is to make the subscription meaningfully less expensive in lower-income territories rather than charging one worldwide United States-equivalent price.
Fair-Price Promise: Spoons will not increase the Spoons-set United States base price above $2.99 per month or $29.99 per year for new, existing, or returning subscribers. Spoons will not intentionally increase a regional base price after Spoons has set it. Spoons may lower prices or add discounted territories. Spoons will not intentionally remove regional pricing solely to charge lower-income territories the full United States-equivalent price.
Annual pricing is generally set at approximately ten months of the corresponding monthly price, rounded to an available store price point. The exact price, taxes, trial terms, and first billing date appear in the applicable store before confirmation.
Appendix A is part of these Terms and lists the current Spoons-set regional schedule. If a listed price point is unavailable in a particular store, Spoons will use the closest available point that preserves the applicable tier as closely as reasonably possible. The amount displayed by Apple or Google before confirmation controls the transaction. Taxes, VAT, regulatory charges, exchange rates, platform rounding, and changes to your store country or region are outside Spoons’ direct control.
- Tier 1: approximately $2.99 monthly and $29.99 annually.
- Tier 2a: approximately $2.49 monthly and $24.99 annually.
- Tier 2b: approximately $1.99 monthly and $19.99 annually.
- Tier 3a: approximately $1.49 monthly and $14.99 annually.
- Tier 3b: approximately $0.99 monthly and $9.99 annually.
Appendix A may be updated to add territories, lower prices, correct a documented configuration error, or reflect an unavoidable store-price-point change. It will not be used to intentionally raise a Spoons-set base price. Historical versions will remain available while Spoons controls the Website. A later routine update to these Terms will not be used to remove or override the Fair-Price Promise.
7. Spoons Diagnosis Fund Commitment
7.1 Allocation formula and fund purity
Beginning with Spoons’ launch on April 2, 2026, once Spoons starts generating income, Spoons commits to allocate 40% of annual after-tax income above the sustainability floor to the Spoons Diagnosis Fund.
For this commitment, “after-tax income” means Spoons gross revenue minus refunds and chargebacks, app-store and payment fees, ordinary and reasonable business operating expenses, and applicable taxes attributable to Spoons income. Partner compensation and legitimate Fund operating roles are business operating expenses calculated before the 40% allocation. They are not paid from the 40% assessment pool.
One hundred percent of the 40% allocation is reserved for funding autism assessments. Allocated money will not be used for ordinary personal spending or unrelated business operations. A later Terms or policy change cannot reclaim or reduce an amount already calculated and allocated, except to correct a documented calculation error or comply with law.

7.2 Sustainability floor
The sustainability floor for 2026 is $48,000. This is a protected minimum before the 40% allocation applies; it is not a cap on what the founder may retain. The founder also retains 60% of qualifying after-tax income above the floor.
Beginning in 2027, the floor will preserve approximately the purchasing power of $48,000 in 2026 dollars. Each year’s floor will equal the prior year’s floor adjusted by the 12-month percentage change through the preceding November in the Consumer Price Index for All Urban Consumers (CPI-U), All Items, U.S. City Average, not seasonally adjusted, as published by the U.S. Bureau of Labor Statistics. The result will be rounded to the nearest $100 and will not decrease because of negative inflation. If that index is discontinued, Spoons will use the closest official successor measure and explain the change publicly.

The ordinary floor will not increase merely because Spoons revenue grows, the founder voluntarily chooses a more expensive lifestyle, or the founder voluntarily relocates to a higher-cost location.
7.3 Temporary essential-needs adjustment
A temporary prospective adjustment may be made only for a serious essential need that cannot reasonably be absorbed under the ordinary formula, such as necessary medical or disability-related expenses, essential safe-housing costs, necessary caregiving obligations, or a severe personal or family emergency.
Every adjustment must disclose the general category, added amount, start date, and expected duration without requiring private medical details. It expires after no more than 12 months unless publicly renewed. It cannot affect money already allocated to the Fund. When independent board oversight exists, renewal must also receive that independent approval.
7.4 Reserve and activation
The Diagnosis Fund commitment runs in three stages.
First, allocation is calculated each calendar year: the 40% applies only to after-tax income above that year's sustainability floor, so a year with no income above the floor allocates nothing.
Second, any amount allocated accumulates in a dedicated reserve from launch onward and is not available for ordinary personal or unrelated operating use.
Third, deployment — actually paying assessment providers — begins only after the revenue thresholds below are met. Calculation and reserving are active now; deployment waits for those thresholds.se.
Limited Fund operations begin after Spoons reaches $10,000 in monthly recurring revenue for three consecutive months. Full-scale operations begin after Spoons reaches $15,000 in monthly recurring revenue for three consecutive months. These are revenue-based conditions, not promised calendar dates.
7.5 Assessments and applicant protections
The Fund may work through vetted partners and pays licensed or otherwise qualified assessment providers directly rather than sending unrestricted cash to applicants.
No purchase, Spoons subscription, or App use is required to seek funding. Eligibility, partners, regions, application procedures, and providers may change as operations develop. No person is entitled to funding until formally approved under the current program rules.
Once an assessment is approved under the Fund, coverage is not conditioned on the assessment producing an autism diagnosis. The Fund pays for access to an assessment, not for a guaranteed result. A person whose approved assessment concludes that they are not autistic will not owe the Fund money merely because of that outcome.
If Fund operations pause or wind down, Spoons will stop creating new commitments before intentionally withdrawing support from approved and booked assessments. Reserved funds will be used to complete approved commitments where legally and practically possible.
7.6 Hardship
A hardship reduction is not available for convenience, discretionary spending, lifestyle expansion, or voluntary relocation. It may be used only when a serious medical, personal, legal, or business event threatens continued operation, including a substantial revenue collapse or severe emergency.
A hardship affects future allocations only. Previously allocated amounts remain reserved unless law requires otherwise. Spoons will publicly disclose the general reason, the amount or period affected, and the plan or condition for resuming the normal allocation.
7.7 Transparency
Beginning with the first full calendar quarter after these Terms take effect, and continuing until the Diagnosis Fund activates, Spoons will publish a short quarterly reserve update no later than 45 days after each quarter ends. The first required update covers the third quarter of 2026. If a quarter had no Spoons revenue, no qualifying income above the sustainability floor, and no Fund reserve activity, Spoons may use a simplified report stating those facts.
Quarterly figures are preliminary and unaudited. They will use year-to-date business records, a prorated year-to-date sustainability floor, and good-faith estimates for taxes or other amounts that are not yet final.
For every calendar year beginning with 2026, Spoons will publish an annual transparency report no later than June 30 of the following year, whether or not the Fund has activated. The annual report will reconcile the applicable quarterly figures and provide the calendar-year calculation. If final tax or accounting information is unavailable by June 30, Spoons may use clearly identified good-faith estimates and will publish an amended final calculation within 60 days after the relevant information becomes final.
Before activation, an annual report may show that no allocation or reserve was required because qualifying income did not exceed the sustainability floor. After activation, the annual report will also include Fund deployment and impact information. Required quarterly reserve updates end after activation, although Spoons may continue voluntary quarterly updates.
Each applicable report will publish, at minimum: total gross Spoons revenue; refunds and chargebacks; app-store and payment fees; qualifying operating expenses; taxes used in the calculation; after-tax income; the sustainability floor and CPI calculation; the amount subject to the 40% formula; the amount allocated; reserve balance; amount deployed; outstanding approved commitments; partner organizations receiving funds; assessments funded by region; cost-per-assessment or regional cost information; and any hardship or essential-needs adjustment. Quarterly reports may omit fields that do not yet apply and state that they are not applicable.
Reports may present operating expenses in reasonable aggregate categories and do not require publication of private tax returns, individual invoices, or recipient-identifying information. If law, personal safety, or a temporary confidentiality obligation prevents publication of a detail, the report will explain the omission and provide the closest lawful aggregate. The calculation method and historical reports will remain publicly available while Spoons controls the Website and will be included in the continuity archive where practical.
8. Diagnosis Access Codes
An adult who receives a confirmed autism diagnosis through an assessment funded by the Spoons Diagnosis Fund receives permanent no-cost access to Spoons. This access is not a temporary promotion and is intended to survive the commercial subscription business.
A valid diagnosis access code is not limited to the device on which it was first redeemed. It may be used on supported devices, and changing phones will not intentionally terminate access. Spoons will maintain independent issuance and recovery records sufficient to support reasonable recovery. Recovery may require verification of the original entitlement.
The closure, merger, withdrawal, or loss of a partner organization will not by itself invalidate a validly issued code or prevent recovery through Spoons.
A code may be revoked only for documented fraud, unauthorized creation or distribution, public sharing that materially compromises the access system, or similarly serious abuse. Revocation will not occur solely because a person stops using the App, changes devices or countries, a partner closes, or Spoons changes its business model.
A diagnosis code will not be revoked solely by an automated system. Every revocation requires documented evidence and human review. While Spoons remains founder-operated, the founder will personally conduct that review. A future foundation or successor must designate an accountable human reviewer. The affected person will receive notice and may request reconsideration. Revocation of App access does not invalidate or question the person’s diagnosis.
If Spoons permanently shuts down, the final paywall-removal update or continuity release described in Section 14 will preserve no-cost diagnosis access where legally and technically possible.
9. Acceptable Use and Intellectual Property
Spoons grants you a limited, personal, non-exclusive, non-transferable right to use the App for its intended purpose while these Terms remain in effect.
You may not misuse the Service, interfere with its operation, circumvent paid access, distribute or sell unauthorized access, use another person’s diagnosis code, generate or distribute unauthorized codes, use the Service unlawfully, or attempt to obtain credentials, private keys, or protected cryptographic material. You may not reverse engineer protected portions of the App except to the extent applicable law expressly permits it.
The App, Website, Spoons name, logo, design, written content, and other Spoons materials are owned by Spoons LLC or licensed to Spoons. These Terms do not transfer ownership or trademark rights to you.
Open-source software included in or later released from Spoons is governed by its stated license. An open-source license does not grant rights to the Spoons name, logo, domain, or branding unless Spoons expressly says otherwise.
10. Your Logs, Export, Import, Backups, and Support Materials
You retain ownership and control of your energy logs and exported files.
Spoons will keep export available without an active subscription and will not separately charge for it, intentionally throttle it, or use access to existing logs as leverage to force payment. Existing history and export access remain available after a trial ends or a subscription is canceled, subject to device storage, technical limitations, legal requirements, and App availability. Canceling a subscription does not intentionally delete local energy logs.
Spoons will continue to provide export in a commonly readable, non-proprietary format. CSV will remain available. Spoons may add fields or improve the CSV structure, but will not intentionally strand existing valid data. Older valid Spoons exports will remain importable, or Spoons will provide a documented conversion path and reasonable migration instructions before a breaking change.
You are responsible for device security and backups. Device loss, damage, storage corruption, operating-system changes, uninstalling the App, disabled backups, or user deletion may cause permanent data loss. Spoons cannot recover ordinary energy logs that were never transmitted to Spoons.
Exports may reveal sensitive routines and energy patterns. Store and share them carefully.
If you voluntarily send Spoons an email, screenshot, export, or other material for support, you give Spoons permission to use it only as reasonably needed to answer you, investigate the issue, improve or protect the Service, comply with law, or carry out your request. The Privacy Policy explains retention and deletion.
11. Third-Party Services
The Service depends on third parties, including Apple, Google, RevenueCat, Webflow, and email, security, or automation providers identified in the Privacy Policy. Their terms and privacy policies apply to their services.
Apple or Google store terms control store purchase confirmation, billing, automatic renewal, cancellation, taxes, and ordinary refund processing where applicable. Spoons does not receive your full payment-card information.
12. Accessibility, Release Testing, and Support Priorities
Spoons will keep these Terms available in plain text, use clear headings and plain language, maintain a concise summary, and provide reasonable accessible formats on request. Available formats may include simplified text, audio, large-print or high-contrast text, or translation assistance where reasonably available.
Accessibility is not a premium feature. Spoons is designed to meet WCAG 2.2 AA where applicable and aims for AAA where practical. Public releases will include documented checks appropriate to the change, including screen-reader behavior, text scaling, reduced motion, contrast, touch targets, and focus behavior.
Every public App update will complete a documented pre-release checklist covering the functions affected by the release and, where relevant, core logging, storage, history, import, export, purchase access, diagnosis access, and accessibility. Emergency security releases may use an abbreviated checklist followed by full regression testing. Testing does not mean that software will contain no bugs.
Credible reports involving possible data loss, privacy or security, broken import or export, lost paid access, or broken diagnosis access receive priority. Spoons will begin investigating critical reports promptly and will not intentionally hide a known widespread critical limitation from affected users. Repair timing may depend on reproducing the issue, operating-system behavior, third-party services, or app-store review.
Please contact hello@getspoons.app for support. Spoons will provide reasonable communication accommodations when email format or language processing creates an accessibility barrier.
13. Material Changes, Availability, and Discontinuation
Spoons may add, modify, or remove non-core features and may suspend portions of the Service. Spoons does not guarantee compatibility with every device or operating-system version forever.
Spoons will provide at least 30 days’ advance notice before a planned material change where reasonably possible. Material changes include changes to data collection, privacy architecture, subscription or store-trial rules, export access, the Diagnosis Fund formula, diagnosis-code conditions, or shutdown protections. Price decreases, newly discounted territories, and corrections that do not increase the user’s Spoons-set base price may take effect without advance notice. Urgent changes required for security, law, platform compliance, or immediate technical protection may take effect sooner and will be explained as soon as reasonably possible.
Notice may be provided through the App, Website, email when Spoons has your email address, or a combination. Because core App use has no Spoons account or engagement notifications, the App and Website are the primary notice channels. Spoons may require active acceptance of updated Terms before continued use.
Changes apply prospectively. They cannot reclaim Fund money already allocated, invalidate valid diagnosis access without the revocation process, retroactively terminate paid access, or override the Fair-Price Promise. Historical versions of these Terms will remain available while Spoons controls the Website.
The core commitments concerning no voluntary commercial sale, local energy logs, no sale of personal information, data portability, allocated Fund money, valid diagnosis access, and shutdown continuity will not be silently removed through a routine policy update.
14. Business Continuity and Permanent Shutdown
14.1 No voluntary commercial sale
Spoons LLC will not voluntarily sell Spoons, the core App, the Spoons user relationship, or the core Spoons intellectual property to another commercial company, and will not voluntarily merge Spoons into one.
This does not prohibit a transfer required by law, estate administration, death or incapacity, or a transfer to a mission-preserving nonprofit, foundation, or designated successor. A permitted successor must formally accept the applicable privacy, Fair-Price, Diagnosis Fund, diagnosis-access, export, continuity, and existing paid-access commitments. Spoons will not voluntarily transfer the Service to a successor that refuses them.
14.2 Planned shutdown notice and subscriptions
Spoons will provide at least 90 days’ advance notice before a planned permanent shutdown. If 90 days is impossible because of death, incapacity, immediate legal requirements, security risk, or platform action outside Spoons’ reasonable control, notice will be provided as soon as reasonably possible.
After a planned shutdown announcement, Spoons will promptly stop offering new subscriptions, remove or disable new purchase options, and take available steps to stop future renewals. Where a store does not permit direct cancellation by Spoons, clear cancellation instructions will be provided.
Monthly and annual subscribers will retain access through the end of their paid period where legally and technically possible. Spoons will not intentionally terminate paid access early merely because shutdown has been announced.
14.3 Annual-subscriber refund assistance
Annual subscribers affected by shutdown will receive specific assistance requesting a refund for the unused portion of paid access. Spoons will publish step-by-step store instructions, provide a prewritten request template and reasonable supporting documentation, respond to individual questions, and provide reasonable appeal assistance when an initial request is denied.
Apple, Google, and applicable law ultimately determine refund approval and the amount paid. Spoons promises the assistance and advocacy described above, not the store’s outcome.
14.4 Final update and source-code release
Before a planned permanent shutdown, Spoons will submit a final App update intended to remove subscription restrictions for all users and preserve local logging, history, reflections, import, export, and diagnosis access without a commercial subscription.
If Apple or Google prevents distribution of the final update, Spoons or its designated successor will publish any legally and technically available alternative.
If Spoons permanently shuts down without a compliant successor, the source code Spoons owns and has the legal right to distribute will be released under the GNU Affero General Public License version 3 (AGPL-3.0). The release will include the available core local functionality and import/export specification. It will exclude credentials, private keys, signing materials, personal information, proprietary third-party assets, and components Spoons lacks permission to redistribute.
Spoons will maintain documented continuity instructions for a successor, executor, or other designated person so the release and shutdown obligations do not depend only on the founder’s availability. The AGPL release does not transfer the Spoons name, logo, trademarks, or domain. If a credible autistic-community continuity version exists and Spoons or its designated successor controls the domain, getspoons.app may redirect users to it.
14.5 Store removal and local data
Removal from an app store does not itself delete energy logs already stored locally on a device. If store removal becomes permanent and prevents normal continuation, Spoons will provide available updates, export guidance, and continuity alternatives, and will apply the permanent-shutdown process where appropriate.
15. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” Spoons disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted or error-free operation.
Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot legally be excluded where you live. The specific binding commitments stated in these Terms remain applicable despite this general disclaimer.
16. Limitation of Liability
To the fullest extent permitted by law, Spoons and its owner, contractors, and service providers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunities, lost goodwill, loss of use, service interruption, or loss of data.
To the fullest extent permitted by law, Spoons’ total liability arising from the Service or these Terms will not exceed the greater of (a) the amount you paid for Spoons during the 12 months before the event giving rise to the claim or (b) $100 USD.
These limitations do not apply where prohibited by law and do not limit liability that cannot legally be limited, including liability for willful misconduct where applicable.
17. Governing Law and Disputes
These Terms are governed by the laws of North Carolina, United States, without regard to conflict-of-law rules. Mandatory consumer protections in your home jurisdiction continue to apply where the law requires them.
Before filing a Service-related legal claim, contact hello@getspoons.app and give both sides a reasonable opportunity to resolve the issue informally. Billing and ordinary refund disputes should also be submitted through the store that processed the purchase.
Unless mandatory law permits or requires another location, legal proceedings must be brought in the state or federal courts located in Wake County, North Carolina. Nothing prevents either party from bringing an eligible claim in small-claims court.
18. General Terms and Contact
These Terms and the Privacy Policy are the entire agreement between you and Spoons regarding the Service, except for purchase terms presented by Apple or Google and any separate written agreement signed by Spoons.
If a provision is unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms.
Spoons is not responsible for delay or failure caused by events beyond reasonable control, including natural disasters, war, government action, widespread network failure, app-store outages, platform enforcement, serious illness, or incapacity. This clause does not erase the reasonable-efforts and continuity obligations expressly stated in Section 14.

Appendix A. Regional Pricing Schedule
This Appendix is part of the Terms. It records Spoons’ current compressed regional pricing schedule adopted from the June 2026 pricing review. The figures below are the Spoons-set base prices before separately applied taxes or store charges. The price shown by Apple or Google before confirmation controls the transaction.
Where a store does not offer the exact listed point, Spoons will use the closest available price that preserves the assigned tier as closely as reasonably possible. The schedule may be updated only as allowed by Section 6: to add territories, lower prices, correct a documented configuration error, or reflect an unavoidable store-price-point change. Annual prices are generally approximately ten months of the monthly price.
