These Terms of Service ("Terms") govern your access to and use of Spoons (the "App") and getspoons.app (the "Website"). By using the App or Website (together, the "Service"), you agree to these Terms. If you do not agree, do not use the Service.

Spoons helps you track energy/spoons. It's not medical advice.
Your logs live on your device by default; you can export them anytime (CSV/JSON).
Pricing & Trial:
- Free trial → then paid subscription, auto-renews monthly or annually
- Regional pricing based on your country (see Section 6 for details)
- US example: $7.99/month or $79.99/year
- Cancel anytime in your App Store / Google Play settings
Fair-Price Promise: Your price never increases. Everyone in your region pays the same price. No tricks.
Billing & Refunds: Handled entirely by Apple / Google (not us).
Age requirement: 16+ (13–15 with guardian permission; under 13 not allowed).
Privacy: Offline-first, no ads, no data sales. Your data stays on your device.

1) What Spoons Is (and Isn't)
Spoons is a self-tracking tool to help you log and understand your energy ("spoons") and patterns.
Spoons does NOT:
- Provide medical advice, diagnosis, or treatment
- Function as a medical device
- Replace professional medical care
For emergencies:
- Do not use Spoons for crisis situations
- Contact emergency services immediately:
- United States: 911
- United Kingdom: 999
- European Union: 112
- Australia: 000
- Or your local emergency number
- For non-emergency medical concerns, consult a qualified healthcare professional
2) Eligibility
Minimum age varies by region:
- United States: 13+ (16+ recommended; 13–15 requires parent/guardian permission)
- European Union: Age varies by country (13–16+ depending on local laws)
- Rest of world: 13+ (16+ recommended; 13–15 requires parent/guardian permission)
General rule:
- Under 16: Use only with parent/legal guardian permission and supervision
- Under 13: May not use Spoons in most regions
If we become aware of underage use without permission, we may restrict access.
3) Privacy & Data Handling
Privacy-first and offline-first:
- Logs are stored locally on your device by default
- No ads, no personal data sales, no tracking
- Our full Privacy Policy at getspoons.app/privacy is part of these Terms
Your data rights:
- Export anytime: CSV/JSON available with no restrictions—this is YOUR data
- Delete anytime: Uninstalling the app removes all local data
- No lock-in: We never restrict or throttle data exports
Regional privacy rights:
European Union / United Kingdom users:
- Right to access: Request all data we hold about you
- Right to erasure: Request deletion of your data
- Right to portability: Export your data (already built-in)
- Right to object: Opt out of optional processing

4) Accounts
Core App features do not require an account.
Subscriptions & billing are handled entirely by Apple App Store or Google Play.
If optional online features are added in the future, they will also follow these Terms & Privacy Policy.
5) Subscriptions, Trials, and Billing
Billing is handled entirely by Apple or Google and subject to their policies.
Free trial (if offered):
- Subscription auto-converts to paid unless cancelled before trial ends
- Check your App Store / Google Play settings to verify trial end date
Auto-renewal:
- Paid subscriptions renew automatically until cancelled
- Cancel anytime in App Store / Google Play settings (not in the Spoons app)
Refunds:
- Issued only by Apple or Google under their refund policies
- We cannot process refunds directly
- Contact Apple / Google support for refund requests
Taxes & fees:
- May be applied by your App Store / Google Play based on your region
- We don't control tax rates or calculations
- Your receipt will show the breakdown

- Brazil: R$27.90/month or R$279.90/year

Tier 3 — Emerging Markets:

Fair-Price Promise (Price Never Goes Up)
Your price is locked forever:
- We will never increase your subscription price
- Cancelling and resubscribing later = same price
- Everyone in your region pays the same fair price
- No "grandfathering" tricks or surprise increases
What CAN change:
- Taxes, VAT, or regulatory fees: Added by governments/stores (we don't control these)
- Currency exchange rates: Handled automatically by Apple/Google
- Store processing fees: Handled by Apple/Google
What will NEVER change:
- Your base subscription price in your local currency
- The price for existing subscribers or returning subscribers
Why Regional Pricing?
We believe autism energy tracking should be accessible globally.
Regional pricing ensures fair access based on local economic conditions—not arbitrary discrimination. A monthly subscription in India costs approximately the same percentage of local income as the US price costs in the US.
Everyone in your region pays the same price. No exceptions.
Annual Subscription Discount
All regions receive the same discount for annual plans: ~17% off (approximately 2 months free).
Examples:
- US: $7.99/month = $95.88/year → $79.99/year (save $15.89)
- India: ₹179/month = ₹2,148/year → ₹1,790/year (save ₹358)
How to Verify Your Price
Before your free trial ends:
- Open App Store / Google Play
- Go to Spoons subscription page
- Your exact price in local currency will be shown before any charges
If your price seems wrong:
- Check your App Store / Google Play account region setting
- Apple / Google determine your region based on payment method location
- Contact hello@getspoons.app if you believe there's an error
Price matching across regions:We do not offer "price matching" between regions. Regional pricing reflects local purchasing power. Everyone in your region pays the same fair price.
7) Your Content & Exports
Ownership:You own your entries, logs, and exports. Always.
Storage:Data is stored locally on your device unless you enable OS-level backups (iCloud, Google Drive, etc.).
Exports:
- CSV/JSON exports available anytime with no restrictions
- Handle exports carefully—they may include sensitive personal information
- We never throttle, limit, or charge for data exports
Support materials:If you send us content (e.g., screenshots for troubleshooting), you grant us a limited license to use it solely to provide support or improve the Service.
8) Acceptable Use
Do not misuse Spoons. Prohibited actions include:
- Illegal activity
- Harassing, abusing, or threatening others
- Reverse engineering, decompiling, or disassembling the app
- Distributing malware or viruses
- Interfering with others' use of the Service
- Circumventing security protections
- Violating others' privacy or intellectual property rights
We may suspend or terminate access for violations.
9) Third-Party Services
We rely on third parties for some functions:
App distribution & billing:
- Apple App Store
- Google Play
Website & email:
- Webflow (hosting)
- Mailchimp (waitlist emails)
- Proton (business email)
Automations:
- Make/Integromat (triggered by you, e.g., contact forms)
Their terms and privacy policies apply to their services.
10) Service Changes
We may add, change, or remove features over time.
We aim to avoid breaking changes and will give reasonable notice of significant updates (via email, in-app notification, or website announcement).
Continued use of the Service after changes = acceptance of those changes.
11) Support, Availability, and Performance
Spoons is designed to be lightweight and reliable.
Performance:
- The app avoids heavy battery drains (no GPS, no constant sensors)
- Performance may vary by device, OS version, and usage patterns

- We aim to respond within 48 hours (often faster)
We do not guarantee uninterrupted or error-free operation, but we work hard to fix issues quickly.
12) Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."
To the fullest extent permitted by law:
- No warranties of any kind (express or implied)
- No warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy
- We do not guarantee uninterrupted, secure, or error-free operation
- We do not guarantee that defects will be corrected
Your local consumer protection laws may provide additional rights that cannot be waived.
13) Limitation of Liability
To the fullest extent permitted by law:
We are NOT liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Lost data, profits, goodwill, or use
- Service interruptions or data loss
Maximum liability:Our total liability is limited to the amounts you paid us in the 12 months prior to a claim (or $100 USD, whichever is greater).
Exceptions:Some jurisdictions don't allow certain limitations. If your local laws grant you additional mandatory rights, those rights are preserved.
14) Indemnification
You agree to indemnify and hold harmless Spoons, its officers, employees, contractors, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your misuse of the Service
- Your violation of these Terms
- Your violation of any laws or third-party rights
15) Communications
Service-related messages:We may send essential communications (e.g., security notices, legal updates, billing confirmations) via email or in-app notifications.
Marketing / waitlist messages:
- Optional—you can unsubscribe anytime
- Unsubscribe link included in every marketing email
- Contact hello@getspoons.app to be removed from all marketing lists
16) Governing Law & Dispute Resolution
Governing law:These Terms are governed by the laws of [Your State], United States, without regard to conflict of law principles.
International users:Your local consumer protection laws still apply where they grant you additional mandatory rights. If there's a conflict between these Terms and your local mandatory laws, your local laws prevail to the extent required.
Disputes:
- Billing disputes: Handle through Apple App Store or Google Play dispute processes
- Service disputes: Contact hello@getspoons.app first for good-faith resolution before pursuing legal action

17) Changes to These Terms
We may update these Terms from time to time.
When we update:
- New "Effective Date" will be posted at the top
- Material changes will receive additional notice (email, in-app notification, or website announcement)
Your options:
- If you disagree with changes, stop using the Service before the new effective date
- Continued use after changes = acceptance of the updated Terms
18) General Provisions
Severability:If any part of these Terms is found invalid or unenforceable, the rest remains in effect.
No waiver:Our failure to enforce any provision is not a waiver of that provision or any other provision.
Assignment:
- You cannot transfer these Terms to anyone else
- We may transfer our rights/obligations in a merger, acquisition, or asset sale
Entire agreement:These Terms + the Privacy Policy = the complete agreement between you and Spoons. They replace any prior agreements.
Force majeure:We're not liable for delays or failures caused by events beyond our reasonable control (natural disasters, wars, pandemics, government actions, internet outages, etc.).
